Dr. Olufemi Olaleye, the Medical Director of Optimal Cancer Care Foundation, is appealing his conviction for rape by the Lagos Sexual Offences and Domestic Violence Court.
The lower court found him guilty on October 24, sentencing him to life imprisonment for defiling his wife’s 16-year-old niece. Olaleye, represented by Dr. Kemi Pinheiro, SAN, argues that the lower court erred in relying solely on the prosecution’s evidence, which lacked credible independent corroboration.
Pinheiro emphasizes the legal requirement for corroborating evidence in cases of child defilement. He also points out the lower court’s failure to invoke Section 167(d) of the Evidence Act 2011 when the prosecution did not present the alleged victim’s birth certificate.
Pinheiro urges the appellate court to discharge and acquit Olaleye, seeking orders to set aside the lower court’s decision in the judgment delivered on October 24, 2023.
